These Terms of Use are intended to define the conditions under which the services of the SoWeSoft Solution (comprising SoWeSign, SoWeRise and SoWeDoc) are made available, as well as the conditions of access and use applicable to the following categories of Users:
For the purposes of these Terms of Use, the following terms shall have the meanings set out below:
User: means any person who logs in to and uses the Solution.
Username and password: means all information required to identify a User on the Solution. The organisation, username and password provide access to services reserved for specific categories of users. The password is confidential.
Solution: means all accessible online services.
Funding Body: means a public body that finances training provided to job seekers by a Training Provider. The Funding Body makes a digital attendance recording solution available to Training Providers for the collection of attendance data.
Digital attendance recording: means a digital signature process used to validate, electronically, a person's presence or participation in an activity.
Signatory: means a person who signs and is bound by their signature.
Training evaluation: means the process of measuring the effectiveness of a training programme by analysing the acquisition of skills, participant satisfaction and the impact on professional performance. It helps identify the improvements required to optimise learning outcomes.
Access to the Solution may only be made via the Internet and requires a prior connection to the Internet using the web address provided to the Client.
The Client shall be solely responsible for its Internet connection and for all associated costs, including telecommunications charges.

The Solution allows Users to access all features according to the user rights defined and configured by a Client administrator. A detailed description of the Solution's features is available in the user guide provided following the execution of the relevant agreement.
Access to and use of all services provided by the Solution are subject to acceptance of these Terms of Use.
If the User does not accept these Terms of Use, they must refrain from accessing the services offered by the Solution.

Any use not expressly authorised by SoWeSoft is unlawful in accordance with Article L.122-6 of the French Intellectual Property Code.

Data entered in free-text fields must be adequate, relevant and limited to what is necessary for their intended purpose, namely: responding to requests relating to a training activity or a learner's training, or submitting a report.
Any personal assessment or value judgement should be avoided, as should any comments concerning a person's behaviour or personality traits.
Information relating to you or other individuals must not contain data concerning health, religion, political, trade union or philosophical opinions, ethnic origin, sanctions or criminal convictions, or sensitive personal data such as the NIR (French national identification number).
Particular care must also be taken with any sensitive personal information that may be mentioned, especially in the event of disclosure following a data security incident.
Please note that comments may be shared with the individuals concerned. For any information relating to your personal data, you may contact your provider's Data Protection Officer (DPO).
SoWeSoft declares that it owns all applicable intellectual property rights.
The right of use granted by SoWeSoft does not result in any transfer of intellectual property rights to the Client.
Accordingly, the Client shall refrain from carrying out any act that may directly or indirectly infringe SoWeSoft's rights in the Software, which is protected in particular by the French Intellectual Property Code.
SoWeSoft involves the processing of personal data. Such processing is subject to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, applicable since 25 May 2018 (the “General Data Protection Regulation” or “GDPR”), as well as amended French Act No. 78-17 of 6 January 1978 on Information Technology, Data Files and Civil Liberties.
This data is processed, stored and secured under the conditions specified in the data protection policy.

Any disputes and related claims concerning the content or use of the Solution, as well as the interpretation of these Terms of Use, shall fall exclusively within the jurisdiction of the competent French courts.
As data controller, the Funding Body processes personal data concerning you for the purpose of managing vocational training programmes. This includes, in particular, the management of your data, digital attendance recording, the management, monitoring and evaluation of vocational training programmes, as well as institutional communications.
You have the right to access, rectify and erase your personal data, to object to the processing of your data and to request restriction of processing.
